I am disputing the collection agency because they have the wrong amount since they are not deducting what I paid to the hospital (original creditor), but I am confused, did the hospital sell this debt because I am being harrassed by another agency entirely. My question is, is it legal for the collection agency to collect on a debt while the original creditor is accepting payment?
I think it is legal, but Collection Agencies have a policy that once a debt is turned over to them, the original creditor cannot collect on it (or it violates the agreement between them).
Most health care places hand their collection efforts off to agencies as a money saving measure. So, they probably did this.
Going forward, I would make payments to the agency, but send a letter to the hospital telling them you are doing this. In addition, DO NOT pay the agency what you have paid to the hospital. Tell them that you paid it to the hospital and that they need to contact the hospital to update the status of the account.

Be very selective though in choosing your collection agency for it will have a significant impact on your business reputation. While price is an important factor to consider in your selection process, you also have to take a look at a collection agency’s services, reputation, and recovery rates that will be applied to the collected account. Ensure that the agency complies with the Fair Debt Collection Practices Act and Fair Credit Reporting Act. Choose a collection agency that can represent you in a professional manner.
